The Blagojevich Fallout

I'd been hearing more and more rumors Blago wasn't going to survive his term, but nobody saw this coming:

CHICAGO — Gov. Rod R. Blagojevich of Illinois was arrested by federal authorities on Tuesday morning on corruption charges, including an allegation that he conspired to effectively sell President-elect Barack Obama’s seat in the United States Senate to the highest bidder.

Mr. Blagojevich, a Democrat, called his sole authority to name Mr. Obama’s successor “golden,” and he sought to parlay it into a job as an ambassador or secretary of Health and Human Services, or a high-paying position at a nonprofit or an organization connected to labor unions, prosecutors said.

He also suggested, they said, that in exchange for the Senate appointment, his wife could be placed on corporate boards where she might earn as much as $150,000 a year, and he tried to gain promises of money for his campaign fund.

If Mr. Blagojevich could not secure a deal to his liking, prosecutors said, he was willing to appoint himself.

“If I don’t get what I want and I’m not satisfied with it, then I’ll just take the Senate seat myself,” the governor said in recorded conversation, prosecutors said.
Just despicable. What else can you say? This is an absolutely radioactive, Hurricane-force event that will have implications in Illinois for years to come.

We saw in LA-2 this weekend about what can happen to Democrats in instances of extreme corruption, even in very blue regions of the country. This case is a little different, in that the person who is responsible for the corruption isn't running for re-election (although Blagojevich hasn't yet declared himself out of the running for 2010!). On the other hand, the scope and the sheer drama of the corruption -- if the charges are validated -- is of greater magnitude than we saw in the Jefferson case, and odds are that at least one or two prominent Illinois politicians will get caught having done something less than above-board.

The Republicans are extremely disorganized in Illinois, but both the governor's seat and Obama's senate seat now need to be considered viable pickup opportunities for them in 2010. The Republican with the strongest statewide brand name is former senator Peter Fitzgerald, who retired from the Senate in 2004. With that said, the Democrats have several rising stars of their own, such as Alexi Giannoulias, Jan Schakowsky, Lisa Madigan, and Luis Guiterrez, all of whom have pretty clean reputations.

And then there is the question of what happens with Barack Obama's senate seat in the meantime. I don't see how it can possibly be acceptable for Blagojevich to have any say in naming Obama's successor, but elections law isn't set up to deal with situations as bizarre as these.

The ultimate judge and jury of senate appointments, we should remember, is the Senate itself, which has the Constitutional authority to decide who it seats in its chamber. There might be some precedent in the New Hampshire senate race of 1974, when the winner of the race remained unresolved after several recounts, and the Senate declared the seat vacant and than mandated a special election. Dick Durbin, Illinois' senior senator, is also calling for a special election. Alternatively, the Senate could simply wait until Blagojevich resigns or is impeached before accepting a replacement to be named by Lieutenant Governor Pat Quinn.

Patrick Fitzgerald is the US Attorney prosecuting Blagojevich -- not Peter. Peter Fitzgerald did nominate Patrick Fitzgerald to the US Attorney position, but they have no relation. :)

To add real quick, Pat Fitzgerald gets around. He took out Ryan, responsible for Scooter Libby and now Blagojevich. When does he decide to run for something? He's gotta be a lock with his record. Of course, with all his experience fighting corruption, he could mastermind the most corrupt political conspiracy ever -- and we'd never catch him. He's that damn talented.

Mule, Obama or his transition don't seem to be involved as this as you would like. Jarrett dropped out suddenly, probably after Blago decided to get something out of this. It's clear they weren't playing along due to Blago calling Obama a "motherf---ker" who wouldn't give him anything. Also, it's being reported now that Rahm Emanuel tipped off the FBI after Blagojevich reached out to Emanuel. They look clean on this one.

And just to further the Fitzgerald mess, the original story was incorrect, Peter Fitzgerald's term ran out in 2004, taken over by Obama. His nomination of Patrick Fitzgerald is his lasting legacy, clearly the hardest working man in government today. I hope he stays where he is, and not mess things up by actually running for office.

Read the transcript! (p. 56) Blago was trying to extort Obama in his conversations with "Advisor A" (Rahm Emanuel?):

Later on November 3, 2008, ROD BLAGOJEVICH spoke with Advisor A.
By this time, media reports indicated that Senate Candidate 1, an advisor to the President elect,
was interested in the Senate seat if it became vacant, and was likely to be supported by
the President-elect. During the call, ROD BLAGOJEVICH stated, “unless I get something
real good for [Senate Candidate 1], sh*t, I’ll just send myself, you know what I’m saying.”
ROD BLAGOJEVICH later stated, “I’m going to keep this Senate option for me a real
possibility, you know, and therefore I can drive a hard bargain. You hear what I’m saying.
And if I don’t get what I want and I’m not satisfied with it, then I’ll just take the Senate seat
myself.” Later, ROD BLAGOJEVICH stated that the Senate seat “is a f***ing valuable
thing, you just don’t give it away for nothing.”

I don't see any evidence that Obama will be marred by scandals and have blood on his hands. His worse political offense? Taking his opponents off the ballot by a legal challenge. He may play ruthless at times but he hasn't played so egregiously outside the lines or done anything to make me believe his administration will be scandal ridden.

Michelle Obama got a raise to 300K in her position as hospital VP, shortly after Obama was elected to the Senate.

Shortly after that time the hospital received millions in PORK requested by Obama.

I hate to be an Obama whipping boy, but I think he is done.

I really don't trust Biden to be president though. I think Obama chose a dunce like Biden, so that nobody would remove Obama from office because of the fear of a total incompetant taking over.

It's really not surprising. As an Illinois resident I can assure you that most Illinoisans have known for a long time how incredibly corrupt he was. The problem was that he ran against someone who was equally corrupt and we opted for the known-corruptness over unknown-corruptness.

Anyone who thinks this has or will have any effect on Obama has no idea what they are talking about.

And just to edify - Louisiana turned red after the disaster of Katrina since the then Democratic governor was blamed for a part in what happened. Also - most of the Democratic core lived in the New Orleans area and they all lost their homes and many are not returning. Not to say the Dems don't have problems. God knows, they always do.

Jack, considering the earmarks (pork) are attached to bills, the amendments, who proposed them and who voted for them are a matter of public record. Have you found anything to prove your theory? Should be a pretty easy one to figure out. Also, considering how pork-style politics were lambasted in the general, I'm sure the McCain campaign (or even his primary opponents) would've blasted him for a supposed corruption yarn.

Blago ia in deep shit. But all accounts seem to indicate that Obama himself did nothing unethical, and when prompted to do so, declined.

Clinton was marred by Whitewater and Gennifer Flowers, but the implication there was that he indulged rather than restrained himself, whereas here we see that Obama is credited with having declined an offer to engage in bribery. This is to his credit, and he has nothing to hide nor is making any attempts to. The suspicion generated by Clinton's denials and obfuscations are not present here. Obama is hiding from nothing, so he has nothing to prove.

If a prosecutor is the way forward for the national party, the Republicans really are out of ideas. Of course, no telling how many more Republicans Fitzgerald may yet indict.

Obama has nothing to do with this. It will have ZERO impact.

As for Illinois Democrats, they will treat him like a rabid dog. William Jefferson was actually RUNNING for office, and he still got 37% of the vote! Ted Stevens came within a whisker of actually WINNING up in Alaska, and that was AFTER being convicted on 7 felony charges.

That's America in the foul remnants of the Bush era. Everything is for sale and the only question is "how much money do you have?"

That's WHY we elected Barack Obama! We're tired of the shit-rain of corruption like a poison fog that fouls everything. The hog is out of the tunnel and running wild.

We want to be able to travel to other countries and not have to hide our passports in fear and have people mock us because our president is a gibbering chimp.

Any Democrat with close ties to Blagojevich won't bother to show up on election night. The name "Democrat" on the ballot might cost whoever gets the nod a few points, but the name "Republican" in 2008 was like a announcing a terminal disease.

Even John McCain ran from the word "Republican" like it was a vicious plague rat gnawing at the seat of his pants.

On his campaign ads, all it said was "GOP" as if the "GOP" rose innocently from the waters like Aphrodite on her shell.

Yet that didn't stop 46% of Americans for voting for them.

In the end this won't matter much to Democrats as a whole. Blago will disappear without a ripple, just as Stevens and Jefferson will do.

I know we must have a culture of corruption because usually when people are indicted, Chicagoans are surprised that what they are charged with is against the law. To Blago's credit, even native Chicagoans are scratching their collective heads over his antics. What a maroon.

i definitely support the idea of a special election. i can't imagine that the indicted governor could appoint anyone who wouldn't be tainted with scandal, even if they didn't trade favors. i don't live in illinois, but if i did i don't think i would feel truly 'represented' unless an election ensured that the people had a voice.

the only fear i would have about that is that anti-democratic backlash would mean a republican would take the seat and lessen the majority in the senate. that would be sad, but maybe better than having someone tainted by scandal.

In 1998, Democrats (the party with the Presidency) became the first party in SIXTY years to win seats in Congress during the sixth year of the President's term. Two of the Republicans who were defeated at the polls that year were house impeachment managers. Clinton's approval ratings went up during the impeachment trial.

Yeah, that did some 'damage' alright.

Democrats are smarter though. Despite some calls from some on the left to impeach Bush/Cheney for manipulating intelligence to lead the country into the Iraq war, Pelosi never took the bait. It's about the only thing Democrats could have done after the 2006 elections that would have saved George W. Bush's Presidency. Much better to have left him alone and let his favorability ratings sink into the mid 20% range.

Emil Jones -- who, as well as being a U.S. Senate contender, is the outgoing Illinois State Senate president, will call the senate back into session:

“The events this morning are shocking. The faith of the citizens of Illinois has once again been shaken. I will call the Senate back in to session to pass legislation that would create a special election for the U. S. Senate seat to help restore the confidence of the people of Illinois during this difficult time," Jones said in a statement.

No word on timing.

Capitol Fax's Rich Miller updates the state of the speculation on the identity of "Senate Candidate 5," the public official who -- from the complaint -- appears to be in the most jeopardy, aside from Blagojevich and Harris. "Senate Candidate 5." He thinks its either Emil Jones or Jesse Jackson, Jr., though it's conceivable that others would fit the description.

Though Fitzgerald warned us not to cast aspersions based on Blagojevich's version of other people's words, this is the damning quote: “We were approached ‘pay to play.’ That, you know, he’d raise me 500 grand. An emissary came. Then the other guy would raise a million, if I made him (Senate Candidate 5) a Senator.”

Here's what we know. Candidate 5 is:

-"publicly reported to be interested in the open Senate seat"

- not who Blagojevich thought Obama wanted

- not someone with whom, by November 10, Blagojevich had a "long, productive discussion"

- someone with fundraising wherewithal who could produce something "tangible up front"

- someone Blago was "getting a lot of pressure" not to appoint

- someone with whom Blago had "a prior bad experience...not keeping his word"

The complaint also says that on November 10, Blagojevich told an advisor to leak to the Sun-Times's Michael Sneed that Blagojevich "is seriously considering Senate Candidate 5 for the open Senate seat" and that the advisor agreed to call the Sun-Times to leak the story, apparently false, that Blagojevich
end of the conversation Advisor A agreed to call the Sun Times columnist to leak the story had a “long, productive discussion” with Candidate 5.

Sneed's November 14 column included this:

Sneed hears Gov. Blago, who will choose Obama's replacement in the U.S. Senate, privately feels there may be only one choice that makes sense: His buddy, outgoing Senate President Emil Jones.

That isn't exactly what they discussed leaking, and the complaint doesn't say whether or not the call was even made, but it's the only Sneed item on the subject that week.

One other tidbit: Jackson isn't particularly known as a fundraising specialist, but Jones, Miller notes, has money in his State Senate account that could be transferred to Blagojevich.

I wonder how quick, logistically, a special election could be held? Also, does Blago sign this bill with no protest or veto first? Though I don't doubt this will have major bipartisan support to override such a scenario. Also, I'm not well versed in the Illinois Constitution, would such a law be legal in Illinois or is the ability to appoint a Senator a statutory right?

Also, sorry for feeding the trolls but sometimes I find it fun. :) Though I had no idea Mule would freak out as much.

Please. Is it possible that Obama is involved? Of course. Is there any evidence at all that he is? Not that's been made public. So those claiming a connection are asserting based on...their own biases and suspicions, assuming to begin with that they must be right and that therefore the facts will fill in to fit their preconceived conclusion.

Personally, I like getting my facts right before drawing conclusions. Those who care about their ideology more than being right can use other methods.

So the new word is that the Republicans are going to fight the next two years based on Democratic corruption? So what are the implications of this.

Firstly, that the Republicans realise they no longer have a leg to stand on when it comes to policy. Americans have become massively more progressive on social issues in the last 8 years, particularly with regards to homosexuality (see support for civil unions and for gays serving openly in the military). Also, most people who felt the balance of the Supreme Court was important to their vote, voted for Obama.

Also, with regards to economic and foreign policy: people are in favour of comprehensive health care coverage, protecting the environment... people are in favour of a large economic stimulus. People are in favour of a withdrawal from Iraq as well as more diplomatic relations with other nations.

So what do the Republicans fight on when they can't fight on policy? They fight on the corruption of politicians. Well I hope they take this fight to us... cos all I can say is if anyone's got an edge on the quantity of corrupt politicians, it's the Republicans. They lost on policy and if they want to fight on corruption, well they'll lose on that too. That's where Blagojevich will come in. But we'll still win.

I am a hardcore Democrat. But if I hear any fellow Democrats defending this guy for a second I am going to punch someone. I hope Fitzgerald destroys Blago's life. I talked to a good liberal friend today who actually called me about it and he told me he was a bit nervous this could have nationwide implications. He told me awhile back about this Governor and how their were accusations back before the election, but for this to happen after.... O it's hilarious.

My friend didn't seem all that worried, but just said there could me more to all this in relation to Obama which could be devastating.

I personally think Obama is in the clear on all of this and should ignore it. He got bigger problems to face in 45 days..

The ILL GOP better get someone good for this position.

**Critical Overlooked Fact** In The New York Times coverage of this story, they include the full federal indictment, which discusses the specific evidence they apparently have on tape, or according to high level witnesses. Among the evidence is a claim that Blagojvich insisted he would be able to trade the Senate seat for an amount of up to $500,000 from Candidate 5, who has at this point not yet been identified. If there is truth to this, someone else will soon be swinging from the political rafters!

I don't think so. It's too early in the election cycle to be a factor in 2010. The guy was trying to extort other Democrats, so it's not like its an indictment on the entire party. In all likelihood, the state legislature that is dominated by Democrats will impeach him if he doesn't resign. And the same legislative body is poised to pass emergency legislation to require a special election for senate appointments.

Honestly, I don't see how it stains the Democrat Brand unless some evidence surfaces that links another prominent party leader to the scam. But at worst, it looks like there may have been a Jesse Jackson Jr or someone of that level who expressed an interest in negotiating with Blago. But, by all accounts, within the Obama camp both Jarret and Emmanuel had an immediate visceral reactions when approached by Blago (and may have in fact cooperated or help instigate the investigation).

All told, I don't think that this story will have much legs. The governors of CT, NJ, and NY were all taken down by scandal pretty recently and it had a limited impact on the party's standing in the state. IL is blue enough where it will be a distant afterthought by 2010.

FWIW, there's a pretty widespread rumor out there that it's been leaked that Candidate 5 is Jesse Jackson Jr; however, the major news organizations are holding back on reporting that allegation until they can get confirmation from a third source.

Obama Wouldn't Play


When the news of the arrest of Illinois Governor Rob Blagojevich broke, it took the RNC less than an hour to try and tie him to President-elect Barack Obama, an attempt so pitiful that even the Washington Times wasn't buying it. Apparently the RNC didn't bother to read the Criminal Complaint.

Here's where it talks about Candidate 1, Obama's preference to replace him in the US Senate:

By this time, media reports indicated that Senate Candidate 1, an advisor to the President-
elect, was interested in the Senate seat if it became vacant, and was likely to be supported by the President-elect. During the call, ROD BLAGOJEVICH stated, “unless I get something real good for [Senate Candidate 1], shit, I’ll just send myself, you know what I’m saying....And if I don’t get what I want and I’m not satisfied with it, then I’ll just take the Senate seat myself.” Later, ROD BLAGOJEVICH stated that the Senate seat “is a fucking valuable thing, you just don’t give it away for nothing.”


But Obama wouldn't play:

ROD BLAGOJEVICH stated that he is "struggling" financially and does "not want to be Governor for the next two years." ROD BLAGOJEVICH said that the consultants (Advisor B and another consultant are believed to be on the call at that time) are telling him that he has to "suck it up" for two years and do nothing and give this "motherfucker [the President-elect] his senator. Fuck him. For nothing? Fuck him." ROD BLAGOJEVICH states that he will put "[Senate Candidate 4]" in the Senate "before I just give fucking [Senate Candidate 1] a fucking Senate seat and I don't get anything."

Later in the conversation, ROD BLAGOJEVICH said he knows that the President-elect wants Senate Candidate 1 for the open seat but "they're not willing to give me anything except appreciation. Fuck them."


No, fuck you, Governor.


Too bad for the Republicans that Blagojevich had no role in Obama's campaign, his transition, and that the two men have never been close.

I think this actually helps Democrats in the 2010 governor race. As has been pointed out, Rod was ALREADY the least popular governor in the country BEFORE this broke. Even so, because of his power and large war chest, an attempt to fight him in the primary, while potentially successful, would have been bloody.

I think our (Dems') chances are much better with Rod out of the way (though I suppose I wouldn't put it past him to run again in spite of this :-p).

Yes, I believe that's the case--but not even been alleged yet, just widespread speculation.

Also, it's not clear if it was Jackson Jr himself, or someone negotiating on his behalf without his direct knowledge or approval. Over the years there have been numerous allegations of Rainbow Push using strong-arm tactics to push for "friends of Jesse" to be appointed to lucrative executive and board positions at major corporations, some of which was possibly done without Jackson Sr's knowledge.

So it's conceivable that someone independent of either Jackson floated the idea of a $500k campaign contribution from Rainbow Push. But even if so, any entanglement that links Jackson Jr or one of his surrogates (or that of any other Democratic) negotiating with Blago will likely short-circuit his career.

Fitzgerald had to have probable cause to get a court order to set the wiretap. It appears that he got a whole series of phone calls, very early in the process. It's interesting that the Obama connection was #1. To me that suggests that this is what started the FBI surveillance.

The better precedent is Frank L. Smith (R) of Illinois. He was elected the general election in 1926. His predecessor died in December of 1926, so the Governor appointed him. The Senate refused to seat him due to corruption both on the basis of that appointment and when he presented himself for the term he was elected to. Note how long ago that was, yet Illinois was electing corrupt politicians.

Patrick Fitzgerald is the Elliot Ness of the 21st century. We need him to continue here in Chicago because Blagojevich is just the tip of the iceberg of corruption that has infiltrated politics here at all levels. Mayor Daley and Todd Stroger are next and I believe Fitzgerald already has an active investigation into Crook County. The Feds raided their offices last year in search for evidence.

As for history. Peter Fitgerald appointed Patrick Fitzgerald (no relation), a prosecutor who couldn't be bought, that pissed off both parties in Illinois. The Republicans were so mad they refused to support Peter in his reelection bid so he chose to just give up his seat. Patrick Fitzgerald was given a C rating by Karl Rove's team. The C meant that he refused to limit his prosecutions to just Democrats. Patrick has bagged both Rs and Ds equally. I hope we get to have him for many more years to come because there still is a lot of work to be done here.

I can understand why the Right are happy about this, but it's clear from their comments that they don't really understand current Illinois political allegiances.
In my fair State, the Sunni/Shia civil wars were entirely waged between Governor Blagojevich and Speaker Madigan - both strong Democrats. It's no joke or snide comment that I'm making when I say that the Illinois GOP, though stronger downstate, is almost a Third Party right now.
The Blagojevich scandal would have slightly bolstered Republican ranks right before this past election, but the only thing currently at stake is the same Senate seat that Barack Obama vacated. If it comes to a vote, Illinoisans won't be swayed to vote for a GOP senator. The Governor's chair is different. I could very well see a Republican manning the State again, should it come to a public vote, and I might even vote for one, given the candidates.
But all this talk about Obama and Blagojevich being all buddy-buddy is outsider-talk from naive political opportunists. I honestly mean this. Our Governor wasn't really seen as a Dem or Rep by the Illinois populace - he was hated before this scandal broke by the exact same folks that gave Obama a warm Grant Park sendoff. I should know - I'm one of them.
Unfortunately for the Republicans across the country who see a Senate opening for their Party, they aren't the ones who might be casting votes in a months' time.

There's a ~50 page complaint that outlines the specific charges and the evidence possessed by the US Attorney that establishes the required elements to secure conviction. Fitzgerald's a pretty smart guy (both legally and politically), so I don't think he would have sought the indictment unless he was confident that he could prevail in court.

@opus 132. I was referring only the the Obama-related negotiation. That appears to have been merely theoretical. "If I do this for you what good will it do for me? What? Nothing for me? Well then fuck you." That's probably within the range of normal horsetrading in politics.

But the other efforts seem to have gone a great deal further, and significant sums of money were mentioned at least by Blago. Whether those constituted an "extortion" or whether some agents made an "offer of a bribe" will remain an issue in court.

While this is shocking news, I think most people aren't surprised. Blagojevich has been under investigation for awhile now and he has performance numbers are in the TEENS. It just illustrates the danger of having power concentrated in one person. I'm not suggesting that Governor Patterson is planning an appointment in New York with untoward motives, but I don't think his decision will be without influence or based upon what is politically in his best interests.

I think it's now safe to retire New Orleans as the most corrupt govt in America (I think Alaska is probably #2 after Illinois. Look for the Obama haters to start yelling guilt by association.
